Terms and conditions of the
“Joker Out Tour” Giveaway
Article 1: Organiser
The organiser of the contest is SHAGADELIC RECORDS d.o.o., Staničeva ulica 6, 1000 Ljubljana (hereinafter referred to as the Organiser). The Organiser conducts and oversees the band contest.
Article 2: Purpose
The purpose of the contest is to find bands/artists interested in performing as opening acts for the Joker Out European Tour in March and April of 2024 (hereinafter referred to as the Joker Out tour). This contest is aimed at promoting the Organiser's brand “Joker Out” and engaging with the music community on social media platforms.
Article 3: Contest Terms and Conditions
3.1: Contest Mechanism
Any band/artist wishing to participate in the contest must:
Record a video showcasing why they should perform as the opening act for Joker Out in their own country. This could include performances, demonstrations, or other creative expressions.
Post the video on social media platforms (such as TikTok, Instagram, Facebook, etc.) with the hashtags #openforjokerout and #nameoftheircountry.
Participants are encouraged to be as creative and engaging as possible in their submissions.
3.2: Participation Restrictions
Employees and external contractors of the Organiser, or their immediate family members, are not eligible to participate in the contest. Participants are only allowed to compete for the concert(s) in the country of their residence.
3.3: Contest Timeline
Submissions are accepted until the 20th of February 2024. Any submissions made after this date will not be considered.
Article 4: Selection of Opening Acts
The band/artist who creates the video which accumulates the most likes/reacts up to and including the 20th of February 2024 will be considered the winner of the contest, for each country respectively. Participants are permitted to submit i. e. post more than one video and post them on multiple platforms, however only the video with the highest number of likes/reacts will be considered eligible for this competition. The organiser reserves the right to deny submissions if they determine the participant or submission is not in line with the organisers standards and values.
The selected bands/artists will be announced on February 22nd 2024.
Article 5: Prizes
The winning bands/artists will have the opportunity to perform as the opening act on the Joker Out concert(s) in the band's/artist's own country. Specific details regarding performance dates and locations will be coordinated with the winners directly.
Article 6: Rights and Responsibilities
By participating in the contest, bands/artists grant the Organiser the right to use their submitted video and band name for promotional purposes related to the Joker Out tour.
Article 7: Announcement of Winners
The selected bands/artists will be announced on the Organiser’s Website and social media platforms. Winners will also be contacted directly via the information provided in their submission.
Article 8: Privacy and Data Protection
The Organiser will protect personal data in accordance with relevant data protection legislation. Participation in the contest constitutes consent for the Organiser to use the data for the purposes of running the contest.
Article 9: General Terms
The Organiser reserves the right to change the terms of the contest or to cancel it due to unforeseen circumstances. Participants will be notified of any changes through the Organiser's Website.

Terms and conditions of the
“Jokervision: Carpe Diem” Giveaway
Article 1: Organiser
The organiser of the giveaway is SHAGADELIC RECORDS d.o.o., Kolarjeva ulica 60, 1000 Ljubljana (hereinafter the Organiser). The Organiser conducts the prize game and arranges for the draw.
Article 2: Purpose
The purpose of the giveaway is to promote and carry out marketing communication of the Organiser's brand “Joker Out” on social media platforms TikTok, Instagram, Facebook and elsewhere.
Article 3: Terms and Conditions
3.1: Mechanism of the giveaway
A Participant is anybody who is participating in the giveaway in any of the following ways:
Participant posts any kind of content on TikTok using both hashtags #jokervision
Participant posts any kind of Instagram using both hashtag #jokervision
Participant posts any kind of YouTube using both hashtag #jokervision
Participant posts any kind of Facebook using both hashtag #jokervision
Participant submits email via the newsletter form on website https://jokeroutband.com (“The Website”).
The Participants can post as much content using hashtag #jokervision as they want, on any platform they wish.
3.2: Participation restrictions
Employees and external contractors of the Organisers of the giveaway or their immediate family members may not participate in the giveaway.
3.3: Timeline of the giveaway
Participation by posting the content with hashtag #jokervision is possible from 23.3.2023 00:00 until 29.4.2023 23:59.
Any posts submitted before or after this timeline will not be considered a valid entry.
The Participants of the prize game cover all the costs of participation in the prize game themselves.
By participating in the giveaway, the participant accepts these general conditions of participation in the giveaway.
Article 4: Cancellation of Participation
At any time during the duration of the giveaway, the Participant can cancel their participation in the giveaway by simply deleting any of their content submitted with both hashtags #jokervision.
Article 5: Prizes
Participants of the giveaway are eligible to win one of the following prizes:
Grand Prize: Trip to Liverpool with 2 friends; including 3 tickets for the Semi-Finals show on XX.5.2023 9pm + a hotel room for 3 people + 3.000 EUR of travel allowance wired to the account of the winner
3x Joker Out - Big Merch Package (Hoodie + Tote Bag + T-Shirt + signed LP Demoni)
6x Joker Out - Small Merch Package (Tote Bag + T-Shirt + signed CD Demoni)
If the Grand Prize Winner is under 18 years old at the time of receiving the award, the Winner must pick at least one adult (18+ years) of the two friends who will from there on be the legal winner of the Grand Prize, with all three names of travellers to Liverpool being listed in the documentation when receiving the award.
Article 6: Picking the Winners
A Jury consisting of representatives of the Organiser of the giveaway is responsible for the organisation, execution and supervision of the giveaway and the drawing of the prize Winners.
The process of picking the winners is two-fold.
First, the Jury will subjectively select 12 best posts from each of the platforms to become the Finalists. Added to the pool of Finalists will be 12 randomly selected participants from the Email/SMS submits via the Website. In total 60 participants will continue to the Finals as Finalists.
Participants chosen as Finalists will be contacted directly on the platform and if any additional public information will be available via the social media profile, they will be contacted there as well. The Jury will give 48 hours to each Participant to reply with personal data as requested, or else their selection could be given to another Participant.
Then, all the Finalists’s names will be printed-out and put through a mechanically random draw of the final Winners, which will be broadcasted live on the Website and possibly on all other social media platforms on 1.5.2023.
For the Grand Prize, the Jury will also randomly select three Reserves, who will be next in line in the event that the Winner of the Grand Prize would not accept the prize in 72 hours after the end of the Live event.
The Winners will be informed again via the data provided in no more than 24 hours after the Live event is finished.
Article 7: Publishing the names of the winners
All prize Winners explicitly permit the publication of their name, surname and photos from the possible awarding of the prize on the Organiser’s Website or any other media and social networks, for which no payment or compensation will be requested from the Organiser. At the same time, they waive the right to review, approve, object to any use of the material, editorial selection or appearance of the material.
The list of prize winners will be published on the Website no later than 24 hours after the ending of the Live event where the Winners will be randomly drawn. The results of the giveaway are final. Appeals against them are not possible.
Article 8: Acceptance of the prize and tax liability
As a prize-winner, the participant is entitled to receive the prize if the Organiser informs them of the prize within the agreed period. The Organiser will send the prizes to the winners' physical or e-mail address within 30 days of the end of the giveaway.
For Participants with the Slovenian tax number: If the prize exceeds the value of 42€, the Participants are aware of the possibility of winning the prize, which is subject to taxation according to the Income Tax Act. The advance payment of income tax for all prizes is paid by the Organiser, and the prize-winners, as persons liable for income tax (paragraph 2 of Article 35 ZDavP-2), are obliged to provide the Organiser in writing with accurate personal data (name and surname, address of permanent/temporary residence, tax office, their tax number ), namely within 7 days at the latest from receipt of the notice of acceptance of the prize (or within another period that will be specified in the received notice of the prize). For the purposes of notification of acceptance of the prize, the winner also provides a contact telephone number. If the Winner does not provide the requested personal data within 7 days after receiving the notification of the prize, the Organiser is no longer obliged to hand over the prize. In these cases (refusal or untimely provision of requested personal data), the Organiser is free from all obligations to the prize winner arising from these rules.
For all other Participants: The burden of any taxation according to any of the local laws for receiving the Prize, lies on the Participant. The Organiser is free from all obligations regarding taxation for non-Slovenian tax residents.
Other possible tax obligations and/or costs related to the prize are covered by the Winner themselves. If the prize winner renounces the prize, they have no claim against the Organiser due to this giveaway. The results are final and appeals are not possible.
Article 9: Prizes in general
A prize cannot be exchanged for the cash equivalent of the prize or any other prize. The winner of the prize cannot assert any claim against the Organiser (e.g. regarding the quality of the award, correction of errors, etc.).
Transferring a prize to a third party is not possible.
In the case of providing incomplete, incorrect or untrue data (e-mail address or other personal data), the Organiser reserves the right to exclude the Participant from the prize game.
The Participant loses the right to the prize if the Organiser determines that:
● The Participant did not meet the conditions of participation;
● The Participant has violated the rules and conditions of participation in the prize game;
● The Participant does not want to fulfil the obligations in accordance with these conditions or did not fulfil them in time;
The Organiser has the right to demand that the prize Winners prove the identity within a
certain period and in the required manner. If the Winners do not want to do this, they forfeit the right to the prize. In the event that a Participant forfeits the right to a prize, the Organiser decides whether to award the Prize to someone else or not.
Article 10: Privacy, protection and use of personal data
The Organiser will carefully protect personal data, in accordance with the Act on the Protection of Personal Data (ZVOP-1) (Official Gazette of the RS, no. 94/2007-UPB1), the Act on Electronic Communications (ZEKom) (Official Gazette of the RS, No. 13/2007-UPB1, 110/2009) and the General Data Protection Regulation (hereinafter GDPR).
According to the GDPR, the controller of personal data may process personal data if the individual's personal consent is given. Personal consent is a voluntary declaration of the individual's will that his personal data may be processed for a specific purpose, which the user confirms as part of submitting the entry for the giveaway by pressing the submit button on the Website’s form.
The general conditions of the giveaway also include the following statement:
“I confirm that I am familiar with the rules of the giveaway. I allow the Organiser to use my personal data for purposes of running this giveaway. I can revoke my consent to the processing of personal data at any time by sending a written request to jokerout.dpo@gmail.com or by mail to Shagadelic Records d.o.o., Kolarjeva 60, 1000 Ljubljana, Slovenia.”
The Organiser, in the role of manager, will use the personal data obtained from the participants exclusively for the following purposes:
● implementation of the giveaway in all aspects
● informing Finalists and Winners about the result of the draw and awarding of prizes (applies only to prizewinners)
● announcements of Finalists and Winners on the Website
The Organiser processes and protects the collected personal data in accordance with the applicable legislation in the field of personal data protection. When conducting this giveaway, all personal data will be carefully protected and only employees who have agreed to the appropriate confidentiality obligations will be allowed access to them.
All data will be stored in the Organiser’s database. and/or with contractual processors of personal data. The Organiser will ensure that the personal data of the individual is processed exclusively for the purposes of running this giveaway.
The Organizer will not transfer or process personal data outside the European Economic Area (EEA) without compliance with the Standard Contractual Clauses on Data Protection (or other similar clauses that may eventually be approved by the European Commission).
The Organiser will under no circumstances pass on or disclose the obtained personal data to third parties.
The obtained personal data is stored in accordance with the statutory period or until the cancellation of the storage of personal data by the participant. The tax number and tax identification number of the winners are kept for 5 years from the awarding of the prizes, or for as long as required by tax legislation.
The participant is aware that:
● they may request access to their personal data
● they may request the correction of inaccurate personal data
● they may request the deletion of personal data (right to be forgotten) if the conditions set out in Article 17 of the GDPR are met, especially in the case of revocation of consent obtained for the processing of personal data for the purposes of this giveaway
● they may request restrictions on the processing of personal data
● they may request the free transfer of personal data in a structured, commonly used and machine-readable format
● they can file a complaint with the supervisory authority if he believes that the processing of personal data violates the General Data Protection Regulation
An individual can submit a request for the enforcement of the rights from the previous paragraph or obtain additional information regarding the processing and protection of personal data from the authorised person for data protection via the email address jokerout.dpo@gmail.com or at the address Shagadelic Records, d.o.o., Kolarjeva ulica 60, 1000 Ljubljana, Slovenia.
Article 11: Rules availability
These rules are available on the Website of the Organiser.
Article 12: Claims and appeals
All complaints and reclamations related to the implementation of the giveaway are handled by the Organiser. In case of well-founded complaints, the Organiser undertakes to resolve them as soon as possible and to notify the Participant or, if necessary, other Participants.
Article 13: The Jury
The Jury consists of five members:
Kris Guštin (Chairman of the Jury),
Bojan Cvjetićanin (jury member),
Jan Peteh (jury member),
Jure Maček (jury member),
Nace Jordan (jury member),
The Jury has the following responsibilities:
● control of the course of the giveaway and determining the winners, in accordance with these rules.
● The Chairman of the Jury will make a record of the giveaway and the winners, which will be kept for a year at the Organiser's address.
● The minutes must be signed by all committee members. All communication with participants is carried out via e-mail address and/or, if this information is available, via their telephone or mobile number.
Article 14: Final provisions
The Organiser reserves the right to supplement and change the conditions of the giveaway, if so required by reasons of a technical or commercial nature or reasons on the part of the public.
The Organiser will keep the participants informed about all the changes and novelties of the giveaway through announcements on the Website.
The Organiser undertakes to do everything in his power to ensure that the giveaway is carried out correctly, and the responsibility does not include cases of force majeure. In case of circumstances beyond the Organiser's control (force majeure, logistical obstacles, technical problems), the Organiser may cancel the giveaway. The Organiser must inform the participants about this. In such a case, the participants are not responsible for the resulting damage. The Organiser's decision on all questions related to the prize game or the application of the rules is final and applies to all participants.
The rules are binding for the Organizer, all employees and other persons who are in any way connected with the giveaway that is the subject of these rules, as well as for the Participants.
